ATTENTION EMPLOYEES:
- YOU HAVE THE RIGHT TO BE PAID OVERTIME AT 1 ½ TIMES YOUR REGULAR RATE OF PAY FOR ALL HOURS WORKED IN EXCESS OF 8 PER DAY OR 40 PER WEEK IF AN APPLICABLE EXEMPTION CANNOT BE PROVEN BY YOUR EMPLOYER.
California law assumes that all employees are entitled to receive Overtime Pay.
- YOU HAVE THE RIGHT TO BE PAID EVERY TIME YOUR EMPLOYER ASKS YOU TO REPORT TO WORK.
You have the right to receive half of a regular day’s pay when your boss asks you to report for a full day’s work and he either sends you home without work or has less than half of a regular day’s hours for you to work.
- YOU HAVE THE RIGHT TO RECEIVE A MINIMUM WAGE OF AT LEAST $15.
50 PER HOUR.
YOU MAY HAVE A RIGHT TO AN EVEN HIGHER MINIMUM WAGE IF THERE IS A CITY OR LOCAL MINIMIMUM WAGE ORDINANCE IN EFFECT AND APPLICABLE TO YOUR EMPLOYMENT.
You have the right to receive gratuities (“tips”) from customers without your employer keeping any portion of them for him/her/itself.
- YOU HAVE THE RIGHT TO BE PAID ALL YOUR WAGES BY YOUR EMPLOYER THE SAME DAY YOU ARE FIRED OR WITHIN 72 HOURS OF VOLUNTARILY QUITTING.
You have the right to seek up to 30 days’ worth of “penalty wages” when your employer does not pay you ALL of your pay on time.
- YOU HAVE THE RIGHT TO BE PERMITTED TO TAKE A 10-MINUTE, COMPLETELY DUTY-FREE, REST BREAK EVERY 4 HOURS (OR MAJOR PORTION OF THE 4-HOUR PERIOD).
If you are not provided these breaks, you have the right to receive 1 full hour of pay for each day that such a violation occurs.
- YOU HAVE THE RIGHT TO A MEAL PERIOD OF AT LEAST 30 UNINTERRUPTED MINUTES IF YOU WORK MORE THAN 5 HOURS PER DAY.
YOU HAVE THE RIGHT TO A SECOND 30-MINUTE UNINTERRUPTED MEAL PERIOD IF YOU MORE THAN 10 HOURS PER DAY.
You have the right to receive 1 full hour of pay for each day that you are not provided with an uninterrupted 30-minute meal period or when you are required to work during your meal period.
- YOU HAVE THE RIGHT TO AN ITEMIZED PAYSTUB OR WRITTEN STATEMENT SHOWING THE FOLLOWING:
o Rate of pay
o Gross wages earned
o All deductions
o The dates for the period the paycheck or cash payment covers
o The dates for the period the paycheck or cash payment covers
o Your employer’s name, address and telephone number
o Your name and last 4 digits of your Social Security Number (or other unique ID)
